Payment schedule
will be as follows:-

issue of acceptance letter by St. George Church. Over and
above the EMD. |
Additional 75% within
30days of issue of acceptance of letter by St. George
Forane Church. EMD shall be adjusted against this second
and last instalment |
The date of
intimation of acceptance shall be the date on which intimation
regarding the final acceptance of the bid is dispatched to the
purchaser by registered with AD post/ Speed Post at his notified
address.
If the purchaser
do not pay the balance of the purchase money in the manner and
with in the date and time specified, the Assets Sales Committee
shall be at liberty to forfeit the Earnest Money and any other
deposit made and proceed to resell the unit
All money received
by way of EMD or other payments, shall be kept in St. George'
Forane Church, Edappally.
RIGHT TO REJECT
OFFERS
The right to
accept or reject any or all offers without assigning any reason
is reserved. The right of negotiations with the highest bidder is
also reserved.
HANDING OVER OF POSSESSION OF SITE
The Church would
hand over possession of the subject property to tenderers
simultaneously with receipt of full amount.
WITHDRAWAL OF OFFER
In case the
successful tenderer withdrawals his offer subsequent to being
accepted by the Asset Sales Committee, any payment made by the
tenderer including EMD would be forfeited by St. George Forane
Church. Edappally.
PROVISION FOR SETTLMENT OF DISPUTES
In case of any
dispute between the parties in respect of interpretation of the
terms of this tender document or anything arising there from,
such dispute or difference shall be referred to the Chancellor of
Archdiocese of Ernakulam - Angamaly. He shall be empowered to
adjudicate and decide the disputes, if any, between the parties
and his decision shall be final, conclusive and binding on both
the parties.
Arbitration
Any disputes
between purchaser and the land owner should be submitted
Chancellor of Archdiocese of Ernakulam- Angamaly. After the
receiving the letter, chancellor will appoint a sole arbitrator
for both parties, the decision of arbitrator will be final and
binding to both parties.
MISPRESENTATION/FRAUD/ BREACH OF TERMS AND CONDITIONS
If it is
discovered at any point of time that the tenderer/ purchaser has
purchased the land by suppression of any fact or misstatement or
misrepresentation or fraud or if there is any breach of the
conditions of the tender or violation of any of the terms of the
sale deed, the sale may be cancelled by the Church . In such an
event tenderer / purchaser will not be entitled to any
compensation whatsoever, or refund of any earnest money or any
other amount paid by him.
1. NOTE
1.Canvassing in
connection with the tenders is strictly prohibited and the tender
submitted by the tenderer who resorts to canvassing shall be
rejected summarily.
2. Tenderer shall
not add any new condition or delete any condition from the offer.
The offer shall be submitted in the form as it is. Any
conditional offer is liable to be rejected summarily. However
their suggestions can be put in the first cover, in Second Cover
only price bid, any other document the bidder should be
rejected.
3. An offer must
be by filling in the enclosed tender forms separately which must
be completed in all respect and all the documents required must
be enclosed. Incomplete offers shall be rejected summiarily.
4. 1. first
concern contains the EMD and all other documents expect price
bid.
4.2. Second Cover
contains only the price bid and those covers rejected those which
are contains other documents except price bid. |
